Torts are civil wrongdoings that are done by one party against another resulting in one party suffering a loss or harm; as a result of the wrongdoing, the injured person may take civil action against the other party, provided it meets the necessary three elements:

 

    • Tortfeasor, or defendant, had a duty to act or behave in a certain way;
    • Plaintiff must prove that the tortfeasor was in breach of that duty;
    • The plaintiff suffered an injury or loss as a result as a result of that breach and it was not too remote.

 

Because torts are a civil action involving private parties, punishment does not include a fine or incarceration. The punishment for tortious acts usually involves restoring the injured party monetarily called compensation.
